Legislation Targeting Crypto Mining Noise Sweeps Across Arkansas Counties

Arkansas counties prepare to fight against the loud noise made by crypto miners.

Several counties in Arkansas are hastily pushing to pass emergency laws to regulate noise levels and other aspects related to the operations of crypto mining facilities.

According to the news report shared by the Arkansas Democrat-Gazette, the move from the counties comes on the heels of new state law regarding cryptocurrency mining.

Set to take effect on August 1st, the incoming state law positions crypto-mining facilities under the same regulatory umbrella as data centers. The legislation introduces guidelines for mining operations and shields them from biased regulations and taxes.

The rapid progression of the legislation, proposed, debated in committees, and approved by lawmakers in a week from March 30th to April 7th, left residents with little time for thorough discussions.

Rick McClure, State Representative and author of the bill, reportedly noted that “no one spoke against this bill in committees or on the legislative floors.”

In response to concerns about noise disturbance, local authorities are stepping in to set stricter regulations. During a July meeting, a justice of the peace on Faulkner County’s Quorum, Kris Kendrick, stated:

I don't have any issues with mining crypto, but just the noise level, the lack of care for our neighbors.

Justice of the Peace Maree Coat emphasized the residents' plight, saying:

I also want to make the point that it’s not these people stepping out on the front porch and <not> being able to enjoy a glass of tea sitting on the back porch. These people can hear this sound 24/7 from their bedrooms.

While the upcoming legislation does not prohibit county-level regulations, it bars local governments from showing intolerance against crypto mining facilities or imposing decibel-level restrictions “other than the limits set for sound pollution generally.”

As the countdown to the new state law begins, Arkansas counties are making a last-ditch effort to implement rules that regulate noise pollution caused by crypto mining operations.
